General Disclaimer
In using TreeEstimate.com?s website service and information, you acknowledge that TreeEstimate.com is not acting as your general contractor, agent, or advisor. It is your sole responsibility to select contractors, subcontractors and suppliers and to negotiate the terms for any work performed and materials purchased. You may want to consult with appropriate advisors to assist you, including a lawyer regarding contracts, permits, and other necessary job documentation and an insurance professional regarding the contractor?s and your own insurance coverage requirements. TreeEstimate.com relies on data provided by third parties and on statements made by service providers and suppliers to determine which service providers and suppliers to include in our website. Actions or other issues affecting a specific record may have occurred which were not included in the third party data sources used. TreeEstimate.com does not guarantee that any service provider or supplier has insurance coverage at the time you enter into an agreement with the service provider or supplier and makes no representation as to the adequacy of any insurance coverage (including amount, breadth, or type). TreeEstimate.com does not endorse any product or service described in or linked to TreeEstimate.com?s website.
Subscriber Agreement
As a member tree service you agree to be billed monthly and are responsible for payment of estimates received from TreeEstimate.com. You understand that payment for one year in advance does not guarantee your company?s continued participation in TreeEstimate.com and that this is not a binding contract. Ties may be severed at TreeEstimate.com?s discretion with no notice. Should this happen TreeEstimate.com will refund any unused portion of yearly dues that were paid in advance for belonging to the zip code(s) you have selected. Should you elect to be removed from TreeEstimate.com, there will be no refund of any unused yearly dues. You also agree that rates and dues may vary at TreeEstimate.com?s discretion. Should this happen you will be notified by TreeEstimate.com in advance and before your annual dues.
Use of Information
You may copy information provided by TreeEstimate.com for your personal use, but you must retain any copyright notice and other proprietary notice on copied information. You are not permitted to reproduce, distribute, transmit, publish, or commercially exploit any information provided by TreeEstimate.com without the appropriate permission of the copyright owner. This prohibition precludes emailing, faxing, posting to any bulletin board, storage in a database accessible to persons other than yourself, or otherwise making information available electronically or in any other form.
Changes to the Service or Terms
TreeEstimate.com may from time to time without notice change, add, or remove certain features of our service or change the terms of this Agreement.
Disclaimer of All Warranties
TreeEstimate.com has no control over any Third Party services or products. TreeEstimate.com and its affiliates make no warranty that the Third Party services or products will meet your requirements. TreeEstimate.com does not make any warranty as to the results that may be obtained from use of Third Party services or products, or the accuracy or reliability of any information obtained from Third Parties. TREEESTIMATE.COM DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, REGARDING ITS WEBSITE OR THE THIRD PARTY SERVICES OR PRODUCTS. IN NO EVENT SHALL TREEESTIMATE.COM BE LIABLE FOR ANY INCIDENTIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER. Disputes
You agree that, unless otherwise prohibited by law, all disputes, claims, or causes of action, in law or equity, arising from or relating to this Agreement or its enforcement, performance, breach, or interpretation shall be resolved solely and exclusively by confidential final and binding arbitration in Toledo, Ohio, United States of America, pursuant to the Rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. Judgment on the arbitration award may be entered into any court having jurisdiction thereof.
Miscellaneous
TreeEstimate.com, and all Third Party providers of services or goods, are separate entities and share no agency, partnership, franchise, joint venture, or employment relationship. You agree that this Agreement will be governed by the laws of the State of Ohio, The United States of America. If any provision of this Agreement is invalid or unenforceable under applicable law, such provision will be deemed modified to the extent necessary to render such provision valid and enforceable and the other provisions of this Agreement will remain in full force and effect. This document and the pages referred to herein represent the entire agreement governing your use of the service and supersede any prior or contemporaneous written or oral statements by TreeEstimate.com or its representatives.
Healthy Trees
While we take every effort to work with companies that are fully insured, it is the responsibility of the individual to ask for proof of insurance. This is common practice!
